Doctors routinely refuse donation offers from prospective living kidney donors with certain comorbidities such as diabetes or obesity out of concern for donor wellbeing. This refusal occurs despite the ongoing shortage of kidney transplants and the superior performance of living donor kidney transplants compared to those from deceased donors. In this paper, we argue that this paternalistic refusal by doctors is unjustified and that, within limits, there should be greater acceptance of such donations. We begin by describing possible weak and (...) strong paternalistic justifications of current conservative donor acceptance guidelines and practices. We then justify our position by outlining the frequently under-recognised benefits and the routinely overestimated harms of such donation, before discussing the need to respect the autonomy of willing donors with certain comorbidities. Finally, we respond to a number of possible objections to our proposal for more liberal kidney donor acceptance criteria. We use the situation in Australia as our case study, but our argument is applicable to comparable situations around the world. (shrink)

According to many researchers, it is inevitable and obvious that psychiatric illnesses are biological in nature, and that this is the rationale behind the numerous neuroimaging studies of individuals diagnosed with mental disorders. Scholars looking at the history of psychiatry have pointed out that in the past, the origins and motivations behind the search for biological causes, correlates, and cures for mental disorders are thoroughly social and historically rooted, particularly when the diagnostic category in question is the subject of controversy (...) within psychiatry. This is obscured by neuroimaging studies that drive researchers to proclaim 'revolutions' in psychiatry, namely in the DSM. Providing neuroimaging evidence to support the contention that a condition is 'real' is likely to be extremely influential, as has been extensively discussed in the neuroethics literature. This type of evidence will also reinforce the pre-existing beliefs of those researchers or clinicians who are already expecting a biological description. The uncritical credence given to neuroimaging research is an ethical issue, not in its potential for contributing to misdiagnosis per se but because of the motivations that often drive this research. My claim is that this research should proceed with an awareness of presumptions and motivations underlying the field as a whole, in addition to an explicit focus on the past and potential future consequences of classification and diagnosis on the groups of individuals under study. The college hookup scene is a profoundly gendered and heteronormative sexual field. Yet the party and bar scene that gives rise to hookups also fosters the practice of women kissing other women in public, generally to the enjoyment of male onlookers, and sometimes facilitates threesomes involving same-sex sexual behavior between women. In this article, we argue that the hookup scene serves as an opportunity structure to explore same-sex attractions and, at least for some women, to later verify bisexual, lesbian, or (...) queer sexual identities. Based on quantitative and qualitative data and combining queer theory and identity theory, we offer a new interpretation of women’s same-sex practices in the hookup culture. Our analysis contributes to gender theory by demonstrating the utility of identity theory for understanding how non-normative gender and sexual identities are negotiated within heteronormatively structured fields. Multiculturalism and “The Politics of Recognition.” An Essay by Charles Taylor with commentary by Amy Gutmann, editor, Steven C. Rockefeller, Michael Walzer, and Susan Wolf.

The inclusion of elite transwomen athletes in sport is controversial. The recent International Olympic Committee guidelines allow transwomen to compete in the women’s division if their testosterone is held below 10 nmol/L. This is significantly higher than that of cis-women. Science demonstrates that high testosterone and other male physiology provides a performance advantage in sport suggesting that transwomen retain some of that advantage. To determine whether the advantage is unfair necessitates an ethical analysis of the principles of inclusion and fairness. (...) Particularly important is whether the advantage held by transwomen is a tolerable or intolerable unfairness. We conclude that the advantage to transwomen afforded by the IOC guidelines is an intolerable unfairness. This does not mean transwomen should be excluded from elite sport but that the existing male/female categories in sport should be abandoned in favour of a more nuanced approach satisfying both inclusion and fairness. Power, Prose, and Purse is an edited collection of essays that draw connections between literature, economics and law. The essays discuss novels that explore the time period between the Industrial Revolution and the Great Depression and analyze the insights that novelists may offer to law and economics, while noting the tensions among these paradigms.

In this paper, we report on the development and validity of the Professional Decision-Making in Research measure, a vignette-based test that examines decision-making strategies used by investigators when confronted with challenging situations in the context of empirical research. The PDR was administered online with a battery of validity measures to a group of NIH-funded researchers and research trainees who were diverse in terms of age, years of experience, types of research, and race. The PDR demonstrated adequate reliability and parallel form (...) correlation. As hypothesized, the PDR was significantly negatively correlated with narcissism, cynicism, moral disengagement, and compliance disengagement; it was not correlated with socially desirable responding. In regression analysis, the strongest predictors of higher PDR scores were low compliance disengagement, speaking English as a native language, conducting clinical research with human subjects, and low levels of narcissism. Given that the PDR was written at an eighth grade reading level to be suitable for use with English as a second language participants and that only one-fourth of items focused on clinical research, further research into the possible roles of culture and research ethics training across specialties is warranted. This initial validity study demonstrates the potential usefulness of the PDR as an educational outcome assessment measure and a research instrument for studies on professionalism and integrity in research. Functional diversity holds the promise of understanding ecosystems in ways unattainable by taxonomic diversity studies. Underlying this promise is the intuition that investigating the diversity of what organisms actually do—i.e. their functional traits—within ecosystems will generate more reliable insights into the ways these ecosystems behave, compared to considering only species diversity. But this promise also rests on several conceptual and methodological—i.e. epistemic—assumptions that cut across various theories and domains of ecology. These assumptions should be clearly addressed, notably for the sake (...) of an effective comparison and integration across domains, and for assessing whether or not to use functional diversity approaches for developing ecological management strategies. The objective of this contribution is to identify and critically analyze the most salient of these assumptions. To this aim, we provide an “epistemic roadmap” that pinpoints these assumptions along a set of historical, conceptual, empirical, theoretical, and normative dimensions. (shrink)

This interdisciplinary volume of contributed essays focuses on issues of gender in the British novel of the eighteenth and nineteenth centuries, particularly Hardy and Trollope. Approaching the topic from a variety of backgrounds the contributors reinvigorate the law-and-literature movement by displaying a range of ways in which literature and law can illuminate one another, and in which the conversation between them can illuminate deeper human issues with which both disciplines are concerned.

Despite the potential political impact of industry attempts to influence public policy about genetic modification, little research has focused on critical understanding of industry perspectives. This article explores the rhetorical and discursive construction of public messages about this controversial issue by two major New Zealand export industries. The kiwifruit industry advocates a very cautious public policy position, while the dairy industry has been a strong advocate for the commercial development of genetic modification. We demonstrate that these industries draw on multiple (...) identities and rationalities to negotiate, express, and elaborate their positions on genetic modification, informed variously by discourses of risk, science, the political economy of the marketplace, and images of the ‘natural’ environment. We suggest that exploring how organizations seek to influence controversial socio-political issues through the management of multiple identities may facilitate greater understanding of viewpoints often represented in the media as two distinct polarities; that is as either ‘for’ or ‘against’ the issues. Although mind‐wandering research is rapidly progressing, stark disagreements are emerging about what the term “mind‐wandering” means. Four prominent views define mind‐wandering as (a) task‐unrelated thought, (b) stimulus‐independent thought, (c) unintentional thought, or (d) dynamically unguided thought. Although theorists claim to capture the ordinary understanding of mind‐wandering, no systematic studies have assessed these claims. Two large factorial studies present participants (N = 545) with vignettes that describe someone's thoughts and ask whether her mind was wandering, while systematically manipulating features relevant to (...) the four major accounts of mind‐wandering. Dynamics explains between four and 40 times more variance in participants' mind‐wandering judgments than other features. Our third study (N = 153) tests and supports a unique prediction of the dynamic framework—obsessive rumination contrasts with mind‐wandering. Our final study (N = 277) used vignettes that resemble mind‐wandering experiments. Dynamics had significant and large effects, while task‐unrelatedness was nonsignificant. These results strongly suggest that the central feature of mind‐wandering is its dynamics. (shrink)

Integrating large language models (LLMs) like GPT-4 into medical ethics is a novel concept, and understanding the effectiveness of these models in aiding ethicists with decision-making can have significant implications for the healthcare sector. Thus, the objective of this study was to evaluate the performance of GPT-4 in responding to complex medical ethical vignettes and to gauge its utility and limitations for aiding medical ethicists. Using a mixed-methods, cross-sectional survey approach, a panel of six ethicists assessed LLM-generated responses to eight (...) ethical vignettes. The main outcomes measured were relevance, reasoning, depth, technical and non-technical clarity, as well as acceptability of GPT-4’s responses. The readability of the responses was also assessed. Of the six metrics evaluating the effectiveness of GPT-4’s responses, the overall mean score was 4.1/5. GPT-4 was rated highest in providing technical (4.7/5) and non-technical clarity (4.4/5), whereas the lowest rated metrics were depth (3.8/5) and acceptability (3.8/5). There was poor-to-moderate inter-rater reliability characterised by an intraclass coefficient of 0.54 (95% CI: 0.30 to 0.71). Based on panellist feedback, GPT-4 was able to identify and articulate key ethical issues but struggled to appreciate the nuanced aspects of ethical dilemmas and misapplied certain moral principles. This study reveals limitations in the ability of GPT-4 to appreciate the depth and nuanced acceptability of real-world ethical dilemmas, particularly those that require a thorough understanding of relational complexities and context-specific values. Ongoing evaluation of LLM capabilities within medical ethics remains paramount, and further refinement is needed before it can be used effectively in clinical settings. (shrink)

These original essays by seven leading contemporary political philosophers spanning the political spectrum explore the possibility of achieving agreement in political theory. Each philosopher defends in a principal essay his or her own view of social justice and also comments on two or more of the other essays. The result is a lively exchange that leaves the reader to judge to what degree the contributors achieve agreement or reconciliation.

Formalised knowledge systems, including universities and research institutes, are important for contemporary societies. They are, however, also arguably failing humanity when their impact is measured against the level of progress being made in stimulating the societal changes needed to address challenges like climate change. In this research we used a novel futures-oriented and participatory approach that asked what future envisioned knowledge systems might need to look like and how we might get there. Findings suggest that envisioned future systems will need (...) to be much more collaborative, open, diverse, egalitarian, and able to work with values and systemic issues. They will also need to go beyond producing knowledge about our world to generating wisdom about how to act within it. To get to envisioned systems we will need to rapidly scale methodological innovations, connect innovators, and creatively accelerate learning about working with intractable challenges. We will also need to create new funding schemes, a global knowledge commons, and challenge deeply held assumptions. To genuinely be a creative force in supporting longevity of human and non-human life on our planet, the shift in knowledge systems will probably need to be at the scale of the enlightenment and speed of the scientific and technological revolution accompanying the second World War. This will require bold and strategic action from governments, scientists, civic society and sustained transformational intent. (shrink)

Traditional accounts of the emergence of professional biology have privileged not only metropolis over province, but research over teaching and laboratory over museum. This paper seeks to supplement earlier studies of the ‘transformation of biology’ in the late nineteenth century by exploring in detail the developments within three biology departments in Northern English civic colleges. By outlining changes in the teaching practices, research topics and the accommodation of the departments, the authors demonstrate both locally contingent factors in their development and (...) continuities with existing traditions in natural history. The appointment of Arthur Milnes Marshall in preference to Louis Miall to the new zoology chair in Manchester in 1879 casts light on contemporary views of the laboratory and museum as ‘equal though different’. The transformation in biology, in Northern England at least, was shaped more by such local institutional changes than by a phoenix-like rise of the laboratory from the ashes of the museum—more by the rhetorical construction of a professional academic community than any dramatic shift in sites. In this period the biology laboratory supplemented, rather than eclipsed, the museum, and the dichotomy between the ‘naturalist’ and the ‘experimentalist’ was far from clear-cut. (shrink)

We describe recent developments in research on mathematical practice and cognition and outline the nine contributions in this special issue of topiCS. We divide these contributions into those that address (a) mathematical reasoning: patterns, levels, and evaluation; (b) mathematical concepts: evolution and meaning; and (c) the number concept: representation and processing.

The bitter, public contest for priority over the discovery of the virus that causes AIDS was officially closed in 1987 with equal credit being awarded to two parties from opposite sides of the Atlantic. One was led by Robert C. Gallo of the Laboratory of Tumor Cell Biology at the National Cancer Institute in the United States and the other was led by Luc Montagnier of the viral-oncology unit at the Pasteur Institute in France. Using citation counts from articles published (...) by the scientific community, a process of alloca tion of credit is examined and compared with this official settlement. A novel pattern emerges. It is found that the scientific community began to redistribute priority when the dispute became highly publicized and took little notice of the official settlement. This, along with the fact that Gallo has now officially been charged with misconduct by an investigative committee, may mean that Montagnier's team may eventually receive sole creditfor the discovery of the AIDS virus. The importance of examining priority disputes from many different angles and the potential for citation analysis in such cases are highlighted. (shrink)

This paper starts from a premise relating to the act of fictional writing about eugenics and the way it may be understood as the embodiment and enactment of social imaginaries. It proposes that literature frequently, if not habitually, expresses the underside of what is expressed in public discourse. That is, far from being the implement of state policy or intervention, it acts in counterpoint to the state, constituting a type of social fantasy in that it explores through the realm of (...) the imagination what might happen. It becomes the arena for contestation, exploration, and nuancing as it essays how ideas from public, ‘real’ life, might transform when acted out. The paper considers two sorts of literary case. First it looks at that of ‘naïve’ literature, harnessed unashamedly to a specific sociological discourse of eugenics. Then, using primarily Ibsen, it considers a subset, the case of literature that does not set out to be explicitly in the service of the cause of eugenics, but is appropriated and disseminated from a platform of eugenics. Lastly, taking the example of Unamuno’s Amor y pedagogía the paper considers literature that exists in a quite different sphere of public awareness. It shows awareness of the arguments and precepts of eugenics and related beliefs and practices, but acts as a transitional space to enable such ideas to be entertained and thought about, without a requirement of acceptance or belief. ABSTRACT Historically, maternal HIV research has focused on prevention of mother‐to‐child transmission and child outcomes, with little focus on the health outcomes of mothers. Over the course of the HIV epidemic, the approach to including pregnant women in research has shifted. The current landscape lends itself to reviewing the public health ethics of this research. This systematic review aims to identify ethical barriers and considerations for including pregnant and postpartum women living with HIV in treatment adherence and retention research. We (...) completed a systematic literature review following PRISMA guidelines with analysis using a relational ethics perspective. The included studies (n = 7) identified ethical barriers related to (a) women research participants as individuals, (b) partner and family dynamics, (c) community perspectives on research design and conduct, and (d) policy and regulatory implications. These broader contextual factors will yield research responsive to, and respectful of, the needs of pregnant and postpartum women living with HIV. While current regulatory and policy environments may be slow to change, actions can be taken now to foster enabling environments for research. We suggest that a relational approach to public health ethics can best support the needs of pregnant and postpartum women living with HIV; acknowledging this population as systematically disadvantaged and inseparable from their communities will best support the health of this population. A recent report by Blumenthal et al.1 provides convincing evidence that at least 15% of Caenorhabditis elegans genes are co‐transcribed within over a thousand operons. Polycistronic transcription of gene clusters is very rare in eukaryotes. The widespread occurrence of operons in C. elegans thus raises some interesting questions about the origin and function of these multigenic transcriptional units. Hardback, $99.00."How plausible, [Dalia Nassar and I] kept asking, is it that women published philosophy in the early modern period and then simply ceased to think and publish (...) philosophy in the nineteenth century?" remarked Kristin Gjesdal recently (interview with Richard Marshall, 3:16am [blog], https://www.3-16am.co.uk/articles/gadamer-herder-and-the-womenphilosophers-of-the-long-nineteen-cent ury?c=end-times-series). Not plausible at all—yet this is what historians of women in philosophy often seem to have assumed, judging by the remarkably small amount of scholarship on nineteenth-century women philosophers compared with those of the early modern period or the twentieth century. Eileen O'Neill, for instance, claims that it was "not a particularly friendly century for women philosophers" (1). In fact, as Gjesdal and Nassar observe, women were "significant contributors" to the "thriving intellectual cultures in German-speaking countries" at this time (1). Gjesdal and Nassar contrast Germanic countries to France and Britain in this regard, yet I would add that nineteenth-century Britain too had a vibrant print and periodical culture that created openings for women philosophers such as Harriet Martineau, Anna Jameson, Frances Power Cobbe, and many others. The broader point remains: the nineteenth century has only seemed empty of women philosophers because we have not yet investigated the women thinkers of this period or challenged the canons and narratives from which they have been excluded.Recognizing German women philosophers is particularly important because the vast majority of scholarship on the nineteenth century focuses on the German tradition. Consequently, unless we recover the work of German-speaking women, we will never change the narrative about this period. This makes the present anthology invaluable for both teaching and research. Edited by Gjesdal and Nassar, it contains new translations, nearly all by Anna Ezekiel, of texts by historical German-speaking women philosophers.Regarding teaching, many courses on post-Kantian European philosophy include no women until Beauvoir or Arendt. Such courses typically cover Fichte, Hegel, Marx, Schopenhauer, Nietzsche, Husserl, and Heidegger. The editors have clearly designed this volume to enable instructors easily to bring women into such courses, by providing extracts—of suitable lengths for teaching—from women affiliated respectively with German idealism and Romanticism (Germaine de Staël, Karoline von Günderrode, and Bettina von Arnim), Marxism (Clara Zetkin, Rosa Luxemburg), Nietzscheanism (Hedwig Dohm, Lou Salomé), and phenomenology (Edith Stein, Gerda Walther). Some of these women are already well-known as political activists, as with Luxemburg and Zetkin, or under the elastic heading of "writers," as with Staël and von Arnim. But this collection presents these women's writings in a new light, showcasing their philosophical side. After all, we have learned to read Marx and Nietzsche philosophically: why not extend the same courtesy to Staël or Luxemburg?For researchers, this collection will likewise be invaluable. Post-Kantian European philosophy has been slow to respond to the wider questioning and broadening of the traditional philosophical canon. It remains sadly common for narratives of nineteenth-century German philosophy to discuss men only—a position that this book makes untenable. Many women wrote philosophy in nineteenth-century Britain, and they wrote across the full range of philosophical topics. Yet these important women thinkers have been left out of the philosophical canon and many of them are barely known today. The aim of this book is to put them back on the map. It introduces twelve women philosophers - Mary Shepherd, Harriet Martineau, Ada Lovelace, George Eliot, Frances Power Cobbe, Helena Blavatsky, Julia Wedgwood, Victoria Welby, Arabella Buckley, Annie Besant, Vernon Lee, and (...) Constance Naden. Alison Stone looks at their views on naturalism, philosophy of mind, evolution, morality and religion, and progress in history. She shows how these women interacted and developed their philosophical views in conversation with one another, not only with their male contemporaries. The rich print and periodical culture of the period enabled these women to publish philosophy in forms accessible to a general readership, despite the restrictions women faced, such as having limited or no access to university education. Stone explains how these women became excluded from the history of philosophy because there was a cultural shift at the end of the nineteenth century towards specialised forms of philosophical writing, which depended on academic credentials that were still largely unavailable to women. It is the ideals ofthe State that govern the educational process, and this in a double sense: schools should train pupils in these values, and at the same time reproduce these values in their functional processes. This malaise does not spring from resistance to the ideals of our era—liberty, equality, fraternity—but from the experience of a surprising fact: the more one exalts that slogan, the more the intellectual task of the school recedes into the background. As a consequence, freedom is reduced to lack of direction, equality to simple indifference, and fraternity to a paralyzing absence ofany meaningful boundaries. School, then—we are still talking about the state education system—may tend to produce what it is trying to avoid: a society both less free and more unequal. It is the apprehension of this future that provokes some disquieting questions among teachers: What use is this? What am I doing? What might I be able to do? In other words: What power do I have? So as to bring out some elements for discussion, and with the goal also of justifying the preceding hypothesis, I am going to approach the problem by first drawing away from it. In the aftermath of the financial crisis, and regular corporate scandals, there has been a growing concern with the moral and ethical foundations of business. Often these concerns are limited to narrow accounts of governance codes, regulatory procedures or behaviour incentives, which are often characterized by neo-liberal bias underpinned by western masculine logics. This book challenges these limited accounts of ethics and responsibility. It looks at the writing of Gayatri C. Spivak who takes globally networked markets, people, and ideas and (...) provides tools to rethink subjectivity, ethics, and corporate governance. Eschewing strict hierarchical notions of authority and identity, Spivak's work invites us to consider who speaks for whom and for what in organizational contexts. Relationality is also to be found in the radical politics and feminist ethics of Judith Butler who continues to draw on and develop her account of performativity to interpret contemporary organizations, management and work. While popular accounts of corporate ethics often concern themselves with the aims and actions of those at the top of organisations, Lauren Berlant focuses on the struggles of those at the bottom of the new social structures created by contemporary forms of capital. Finally, the book also considers ecological challenges through the work of Val Plumwood, who spent a lifetime considering the threats and responsibilities we face in environmental terms, and developed a feminist ecological philosophy for understanding social and species differences. In recent decades in North American social and moral philosophy, alongside the development and discussion of widely influential theories of justice, taken as Rawls takes it as the ‘first virtue of social institutions,’ there has been a counter-movement gathering strength, one coming from some interesting sources. For some of the most outspoken of the diverse group who have in a variety of ways been challenging the assumed supremacy of justice among the moral and social virtues are members of those sections (...) of society whom one might have expected to be especially aware of the supreme importance of justice, namely blacks and women. Those who have only recently won recognition of their equal rights, who have only recently seen the correction or partial correction of long-standing racist and sexist injustices to their race and sex, are among the philosophers now suggesting that justice is only one virtue among many, and one that may need the presence of the others in order to deliver its own undenied value. Among these philosophers of the philosophical counterculture, as it were - but an increasingly large counterculture - I include Alasdair MacIntyre, Michael Stocker, Lawrence Blum, Michael Slote, Laurence Thomas, Claudia Card, Alison Jaggar, Susan Wolf and a whole group of men and women, myself included, who have been influenced by the writings of Harvard educational psychologist Carol Gilligan, whose book In a Different Voice caused a considerable stir both in the popular press and, more slowly, in the philosophical journals.
